1.1 Acceptance of Terms

By creating an account or using NutriPlan (the “Service”), you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Service.

1.2 Description of Service

NutriPlan is a meal planning application that generates recipe and meal plan suggestions, nutritional estimates, and shopping lists based on information you provide (including dietary preferences, allergen information, and, optionally, health-condition filters). The Service is intended for general meal planning purposes and is not a medical or clinical product.

1.3 Health & Nutrition Disclaimer

NutriPlan provides meal planning and nutrition information for general educational and informational purposes only. It is not intended as, and should not be used as a substitute for, professional medical advice, diagnosis, or treatment. NutriPlan is not intended to diagnose, treat, cure, or prevent any disease. Always consult a qualified healthcare provider, registered dietitian, or physician before making significant changes to your diet — especially if you have a medical condition, food allergy, are pregnant or breastfeeding, or are managing a chronic illness.

Nutritional values, calorie targets, and recipe information are calculated using standard databases and formulas and may not account for individual variations in metabolism, health status, or specific dietary needs. While we take care to flag common allergens, NutriPlan cannot guarantee complete accuracy of allergen or nutritional data — always verify ingredient labels yourself if you have a severe allergy or intolerance.

By using NutriPlan, you acknowledge that any decisions about your diet and health remain your own responsibility, made in consultation with appropriate medical professionals where needed.

1.4 User-Submitted Recipes

If you create or submit your own recipes (“User Recipes”) within NutriPlan, you are solely responsible for the accuracy of all information you provide, including ingredients, allergen information, and nutritional estimates. NutriPlan does not independently verify User Recipes. Allergen and health-condition filters rely on the information you enter and do not guarantee the accuracy of User Recipes — always verify ingredients yourself. NutriPlan disclaims all liability for inaccuracies, omissions, or errors in User Recipes, including any resulting allergic reactions or adverse health effects.

1.5 Limitation of Liability

To the fullest extent permitted by applicable law, NutriPlan and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, health outcomes, or goodwill, arising out of or in connection with your use of, or inability to use, the Service.

Except where prohibited by law, our total liability to you for any claim arising from or related to the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) fifty euros (€50).

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or willful misconduct.

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to accuracy, completeness, or fitness for a particular purpose of any nutritional or recipe information provided.

Note for counsel: EU consumer protection law does not allow liability for personal injury from negligence to be excluded by contract, regardless of the cap above — the carve-out paragraph is included for that reason. Please confirm the cap amount and wording are appropriate given the product’s health-adjacent nature.

1.6 Governing Law

These Terms are governed by the laws of the Czech Republic, without regard to conflict of law principles. Nothing in this section limits any mandatory consumer protections you are entitled to under the laws of your country of residence, where applicable — TO BE CONFIRMED WITH COUNSEL, especially given a non-Czech/international user base.

1.7 Changes to Terms

We may update these Terms from time to time. Material changes (including changes to this Health Disclaimer or Limitation of Liability) will be communicated to users, and continued use of the Service after such changes constitutes acceptance.
